Governing law:
The use of this website, products supplied through it and purchases are governed by English law and deemed to have occurred in mainland United Kingdom. The courts of England and Wales will have exclusive jurisdiction to hear and deal with any proceedings.
Validity:
If any part of these terms and conditions are deemed to by unenforceable, void or invalid they will be considered severable from these terms and conditions. The remainder of these terms and conditions will however still be considered valid.
You, the customer, promise that you are at least 18 years of age and have the legal right to enter into this agreement with us. You further promise to provide us with details to check the validity of any debit and or credit transactions and that all of the information supplied to us is true. By clicking the ‘Place Order’ button you are confirming your commitment to pay for all items in your basket at checkout, including shipping costs.
Refusal:
We reserve the right to refuse any order or transaction without giving notice and for whatever reason, whether or not monies have been paid. The placing of an order does not establish a contract between you, the customer, and us, the company. A contract is deemed to exist once goods have been despatched to you.
Payments:
We accept payment by the following three methods;
- Credit/ debit card
- PayPal
- BACS transfer.
Payment links/ details will be shared with you at the checkout page. Please do not email over credit card details, as we can not accept responsibility for the security of your details in this case.
Pricing:
We offer pricing options in British Pounds Sterling, Euros and US Dollars. For UK domestic orders, you will be charged 20% VAT at checkout. For, international shipping the prices shown will be excluding VAT.
Shipping including duties & taxes:
All shipments are made using DHL global express services, and the cost of this service will be confirmed to you at checkout. We reserve the right to use alternative carriers, without prior notice or agreement.
For orders placed before 1400 GMT, Monday – Friday we will dispatch on the same day. For orders placed after this time, the order shall be dispatched on the next working day.
You are responsible for paying all customs/ duties/ taxes & associated costs, these figures are NOT included in the cost shown at checkout.

Stock Availability:
We endeavour to keep sufficient stock to cover all orders however from time to time an item may be out of stock even if this is not shown on the website. If an item you have ordered should be out of stock we will contact as soon as possible to let you know when, the item will become available again.
Returns & Cancellations Policy:
14 Days Return Policy:
If you change your mind about your purchase goods may be returned to providing you notify us, by telephone and/or in writing within 14 days of their receipt. Goods may not be returned without prior authorisation, or without a RMA number. Goods must be returned to us in the original packaging and in an as new condition for resale.
The company reserves the right to charge for any product which is returned in an unsatisfactory condition up to 100% of the product cost. The goods remain the responsibility of the customer until they are received by us – customers are advised to return all goods using a recorded delivery method. The customer is responsible for all taxes, duties, fees associated with returning the goods if shipping from outside of the UK.
The company does not refund the cost of returning products to us or the original shipping charge in these circumstances.
Goods are to be returned in an as new condition. If the product is found to have been damaged including outer packaging, and any accessories missing then a re-stocking fee shall be charged at The Company’s discretion. Depending upon damages this will range from 20% to 100% to be deducted from your refund.
This does not affect your statutory rights under the Consumer Protection (Distant Selling) Regulations 2000.
Warranty, for new products, this excludes our refurbished units:
You are provided with, at no additional cost a two (2) year warranty period which commences from date that you receive the goods. The Company, at it’s sole discretion, repair or replace any components which fail under normal use. Normal use as defined by using the product as intended including powering, mounting of the device as per it’s set up guide using the supplied fixtures and fittings. Such repairs carried out under this warranty are provided free of charge including parts and labour. The customer, is responsible for return carriage including all duties and taxes for the return of the product. The company, bares no responsibility for any damage or loss occurring during postage.
The warranty does not cover failures due to abuse, misuse, accident, alteration or repairs. To return any item please contact our service department on info@quark-elec.com so that we can agree to return the product, and issue you with an RMA number. Please do not return items without prior authorisation.
The warranty is non-transferable, and applies only to the name on the invoice.
Warranty, for our refurbished units:
All products come with a 60 day warranty period from date of purchase. We will not accept a return based upon cosmetic imperfections, so please ensure that you have read the item description and view the photo’s carefully prior to purchase.
The Company, will at it’s sole discretion repair or replace any products which fail under the normal operational conditions as defined above.
The Company, if deemed necessary will replace the product on a like for like basis. Should there not be a refurbished sample available, The Company, reserves the right to request additional payment towards the cost of a brand new unit. This is evaluated on a case-by-case basis. The Company’s decision is final.

Complaints:
Customer satisfaction is extremely important to us, and we pride ourselves in our exception customer service and technical support. However, we do also understand that sometimes things can go wrong. If you wish to raise a compliant, please email us on info@quark-elec.com marking your email for the attention of the “Office Manager”.
We will acknowledge your complaint within 48 hours, excluding bank holidays, weekends and seasonal holidays. Your complaint will be investigated and the results of our investigation will be communicated to you in an agreed timescale.
Disclaimer:
It is the responsibility of the customer to use the products prudently. The Company, nor it’s distributors accept responsibility or liability to either you person, or property, for any loss, accident, injury or damage whatsoever arising from misuse, or inability to use the products correctly. Marine products are designed to aid navigation and should be used in conjunction with normal navigation procedures and practices.
